Terms and Conditions

1. Introduction and Acceptance

1.1 Agreement to Terms

Welcome to Find Me Wallet Card ("Find Me," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of the Find Me website (findme.knvs.net), services, and products, including our physical wallet cards and digital profile system (collectively, the "Services").

By accessing or using our Services, creating an account, or purchasing a Find Me card, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use our Services.

1.2 Eligibility

  • You must be at least 18 years old to create an account and purchase Find Me cards
  • If you are under 18, a parent or legal guardian must create the account and make purchases on your behalf
  • You must provide accurate and complete information when creating an account
  • You must be capable of forming a binding contract under applicable law

1.3 Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by:

  • Posting the updated Terms on our website
  • Sending an email notification to registered users
  • Displaying a notice on your dashboard

Your continued use of the Services after changes become effective constitutes acceptance of the modified Terms.

2. Account Registration and Security

2.1 Account Creation

To use our Services, you must:

  • Create an account with a valid username and password
  • Provide a valid email address
  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate

2.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access or security breach
  • Taking reasonable steps to protect your account from unauthorized access

Note: We are not liable for any loss or damage arising from your failure to protect your account credentials.

2.3 Account Termination

We reserve the right to suspend or terminate your account if:

  • You violate these Terms
  • You provide false or misleading information
  • Your account is used for fraudulent or illegal activities
  • You fail to pay for Services rendered
  • We determine, at our sole discretion, that termination is necessary

You may terminate your account at any time by contacting customer support at findme@kanvas.co.za.

3. Products and Services

3.1 Find Me Cards

We offer two types of physical cards:

  • Stock Find Me Card: Standard card with Find Me branding and unique QR code
  • Custom Photo Card: Personalized card with your uploaded photo and unique QR code

Each card includes:

  • A unique QR code linked to your digital profile
  • Durable plastic construction
  • Water-resistant design
  • Professional printing quality

3.2 Digital Profile Service

When you purchase a Find Me card, you receive access to:

  • A personalized digital profile accessible via QR code
  • Ability to add and manage contact information
  • Profile customization options (photos, colors, descriptions)
  • Real-time profile updates
  • Emergency SMS notification features (subject to credit availability)

3.3 Activation

  • Each physical card must be activated using a unique 8-digit activation code
  • Activation codes are provided with your physical card shipment
  • Cards remain inactive until you enter the activation code in your dashboard
  • Once activated, cards cannot be transferred to another user account

3.4 Service Limitations

Important: We do not guarantee:

  • That lost items will be returned
  • That finders will contact you
  • The honesty or reliability of individuals who find your items
  • Uninterrupted access to digital services
  • That QR codes will scan in all conditions

4. Pricing and Payment

4.1 Pricing

Current pricing (subject to change):

  • Stock Find Me Card: R180.00 per card
  • Custom Photo Card: R260.00 per card
  • Standard Delivery: R220.00
  • Free Delivery: On orders over R1,800.00

All prices are in South African Rand (ZAR) and include applicable taxes.

4.2 Payment Processing

  • Payments are processed securely through PayFast
  • We accept credit cards, debit cards, and instant EFT via PayFast
  • Payment must be received before order processing begins
  • You are responsible for any payment processing fees charged by your financial institution

4.3 Order Processing

  • Orders are processed within 3-5 business days after payment confirmation
  • Manufacturing and shipping typically take 7-10 business days total
  • Tracking information will be provided via email
  • We are not responsible for delays caused by courier services or customs

4.4 Refunds and Returns

Refund Policy:

  • Physical cards cannot be refunded once manufactured (personalized products)
  • Refunds may be issued if:
    • Cards are not delivered within 30 days
    • Cards arrive damaged or defective
    • We are unable to fulfill your order

4.5 Price Changes

We reserve the right to change prices at any time. Price changes will not affect orders already placed and confirmed.

5. User Content and Conduct

5.1 User-Generated Content

You retain ownership of all content you upload or submit to Find Me, including:

  • Profile photos
  • Background images
  • Contact information
  • Profile descriptions

By uploading content, you grant Find Me a worldwide, non-exclusive, royalty-free license to:

  • Display your content on your digital profile
  • Store and process your content on our servers
  • Use your content to provide the Services
  • Reproduce content for technical purposes (backups, caching)

5.2 Content Standards

You agree not to upload or submit content that:

  • Is illegal, harmful, threatening, abusive, harassing, defamatory, or invasive of privacy
  • Contains nudity, sexually explicit material, or pornography
  • Infringes on intellectual property rights of others
  • Contains viruses, malware, or malicious code
  • Impersonates any person or entity
  • Contains false or misleading information intended to deceive

5.3 Content Removal

We reserve the right to remove any content that:

  • Violates these Terms
  • Violates applicable laws
  • Is reported by other users as inappropriate
  • We determine, at our sole discretion, is unsuitable for our Services

5.4 Prohibited Activities

You agree not to:

  • Use the Services for any illegal purpose
  • Attempt to hack, reverse engineer, or compromise our systems
  • Create multiple accounts to circumvent restrictions
  • Use automated systems (bots, scrapers) to access the Services
  • Harass, abuse, or harm other users
  • Sell or transfer your account to others
  • Use the Services to spam or send unsolicited communications
  • Interfere with or disrupt the Services
  • Collect information about other users without their consent

6. Intellectual Property Rights

6.1 Our Intellectual Property

All content, features, and functionality of the Find Me Services, including but not limited to:

  • Text, graphics, logos, icons, and images
  • Software, code, and design
  • Trademarks, service marks, and trade names
  • The Find Me name and logo
  • The compilation, organization, and display of content

are owned by Find Me, Kanvas Creative Solutions, or our licensors and are protected by South African and international copyright, trademark, patent, trade secret, and other intellectual property laws.

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Access and use the Services for personal, non-commercial purposes
  • Use your Find Me card as intended
  • Display your digital profile via QR code

6.3 Restrictions

You may not:

  • Copy, modify, or create derivative works of our Services
  • Distribute, sell, or sublicense our intellectual property
  • Remove or alter copyright notices or trademarks
  • Use our trademarks without prior written permission
  • Frame or mirror any part of the Services

7. Third-Party Services

7.1 PayFast Payment Processing

  • Payment processing is provided by PayFast (Pty) Ltd
  • PayFast's terms and conditions apply to all transactions
  • We are not responsible for PayFast's services or payment processing issues
  • Payment information is transmitted directly to PayFast and not stored by Find Me

7.2 Courier Services

  • We use third-party courier services for product delivery
  • We are not responsible for courier delays, lost packages, or delivery issues beyond our control
  • Claims for lost or damaged shipments must be made within 7 days of expected delivery

7.3 QR Code Technology

  • QR codes are generated using third-party libraries
  • We do not guarantee QR code compatibility with all devices
  • Users must have a compatible smartphone with camera to scan QR codes

7.4 Third-Party Links

  • Our Services may contain links to third-party websites
  • We are not responsible for the content, privacy practices, or terms of third-party sites
  • Accessing third-party links is at your own risk

8. Privacy and Data Protection

8.1 Privacy Policy

Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

8.2 POPIA Compliance

We comply with the Protection of Personal Information Act, 2013 (POPIA). See our POPIA Compliance Statement for details on how we process personal information.

8.3 Data Sharing

By using Find Me:

  • You consent to your contact information being displayed when someone scans your QR code
  • You understand that finders of your items can view your profile information
  • You control what information is visible on your profile
  • You can deactivate your card at any time to stop information sharing

9. Disclaimers and Limitations of Liability

9.1 Service "As Is"

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties of non-infringement
  • Warranties regarding security, accuracy, or reliability
  • Warranties that the Services will be uninterrupted or error-free

9.2 No Guarantee of Results

We do not guarantee:

  • That lost items will be recovered
  • That finders will contact you or return items
  • The honesty or reliability of individuals who find your items
  • That your profile will be accessible at all times
  • That QR codes will work in all circumstances

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIND ME AND KANVAS CREATIVE SOLUTIONS SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or use
  • Loss of or damage to property
  • Personal injury or death (except as caused by our negligence)
  • Damages arising from lost or stolen items
  • Damages arising from interactions with third parties who find your items
  • Damages exceeding the amount you paid for the Services in the 12 months preceding the claim

9.4 Geographic Limitations

Our Services are designed for use in South Africa. If you access the Services from outside South Africa:

  • You are responsible for compliance with local laws
  • Services may not be available or may function differently
  • Support may be limited

10. Indemnification

You agree to indemnify, defend, and hold harmless Find Me, Kanvas Creative Solutions, and our officers, directors, employees, agents, and licensors from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your violation of these Terms
  • Your violation of any rights of third parties
  • Your misuse of the Services
  • Content you submit or upload
  • Your interactions with individuals who find your items
  • Any false or misleading information you provide

11. Dispute Resolution

11.1 Governing Law

These Terms are governed by the laws of the Republic of South Africa, without regard to conflict of law principles.

11.2 Jurisdiction

You agree that any legal action or proceeding arising out of these Terms shall be brought exclusively in the courts of South Africa, and you consent to the jurisdiction of such courts.

11.3 Dispute Resolution Process

Before initiating legal proceedings, you agree to:

  1. Contact customer support at findme@kanvas.co.za to attempt resolution
  2. Provide detailed information about your dispute
  3. Allow us 30 days to investigate and respond
  4. Engage in good faith negotiations to resolve the dispute

11.4 Arbitration

If informal dispute resolution is unsuccessful, disputes may be resolved through arbitration under the rules of the Arbitration Foundation of Southern Africa (AFSA), before resorting to litigation.

12. General Provisions

12.1 Entire Agreement

These Terms, together with our Privacy Policy and POPIA Compliance Statement, constitute the entire agreement between you and Find Me regarding the Services.

12.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

12.3 Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

12.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.

12.5 Force Majeure

We are not liable for any failure or delay in performing our obligations due to causes beyond our reasonable control, including:

  • Natural disasters
  • War, terrorism, or civil unrest
  • Government actions or regulations
  • Power outages or telecommunications failures
  • Strikes or labor disputes
  • Pandemics or public health emergencies

12.6 Relationship

Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and Find Me.

12.7 Survival

Provisions that by their nature should survive termination (including but not limited to intellectual property rights, indemnification, limitations of liability, and dispute resolution) will survive termination of these Terms.

14. Special Provisions

14.1 Children's Safety

While Find Me cards can be used for children's safety:

  • Parents/guardians must create and manage accounts for minors
  • Parents are responsible for the information displayed on children's cards
  • Parents should educate children about the proper use of their cards
  • We recommend not including children's photos on publicly visible cards
  • Emergency contacts for children's cards should be parents/guardians only

14.2 Emergency Services

Find Me is NOT a substitute for emergency services:

  • In medical emergencies, call emergency services (10111, 112, or local emergency numbers)
  • Find Me cards are supplementary tools to help connect finders with owners
  • We are not responsible for emergency response times or outcomes
  • Emergency SMS features depend on SMS credits and network availability

14.3 SMS Credits

  • SMS notifications require purchased credits
  • Credits are non-refundable
  • We are not responsible for SMS delivery failures
  • SMS rates and credit prices may change with notice

14.4 Multiple Cards

  • You may purchase multiple cards for different items
  • Each card must be activated individually
  • You can manage multiple cards from one account
  • Pricing applies per card, not per account

15. Acknowledgment

BY CREATING AN ACCOUNT, PURCHASING A FIND ME CARD, OR USING OUR SERVICES, YOU ACKNOWLEDGE THAT:

  1. You have read and understood these Terms and Conditions
  2. You agree to be bound by these Terms
  3. You understand the limitations and disclaimers outlined herein
  4. You have the authority to enter into this agreement
  5. You will comply with all applicable laws and regulations
